Terms of participation in Flat Tyres bike tours
The cycling tours implemented by FLAT TYRES are geared towards people of various ages & fitness levels. The age limit, the difficulty degree, the route, the level of fitness of participants/ cyclists, the individual regulations and conditions of participation, the registration form and relevant information are detailed at ‘Tours’ .
Underage participants: Cyclists under 18 years of age participate under the responsibility of their guardians and are accompanied by them.
The only condition for all adult or minor cyclists to participate in cycling tours is good mental and physical health, the willingness to cooperate with other participants and the compliance of the advice/ regulations of the organizers/ tour leaders/ co-leaders.
Any health problem of the adult or minor participant/ cyclist should be reported as the adult (or the guardian of a minor) assumes full responsibility of his or her own health and of that of the person he / she guards, during all Flat Tyres cycling tours.
Underage or adult participants / cyclists are fully responsible for the storage of their personal belongings-equipment during the cycling tour.
Participants / cyclists are required to complete their electronic registration on time and deposit the money on the dates indicated.
Awareness and acceptance of objective risk
Participants are aware of and accept the potential risks involved in cycling tours and are aware of the risk of moving them through central and peripheral roads or other dirt or stone terraces etc.
Participants / cyclists are recommended to have recently undergone a medical examination. FLAT TYRES company will not require a medical certificate, since all participants / cyclists participate on their own sole responsibility and declare so.
Technical Information
At the beginning of a cycling tour, all the details are presented and a detailed technical briefing is conducted.
Liability of Flat Tyres company
As an organizing company of cycling tours Flat Tyres has the obligation to provide the best and safest equipment that meets international standards, ensure the best possible design for safe routes, provide experienced and trained tour leaders / co-leaders, to inform participants of any risk assessment.
Flat Τyres organizer company is not responsible for the injury or any damage to the health of the participants or for any health problems, or for death due to a lack of preventive medical control or due to a fall of the participant/ cyclist.
Flat Tyres organizer company disclaims any responsibility regarding the physical integrity of the participants/ cyclists/ athletes, who should behave responsibly throughout the ride.
Flat Tyres organizer company bears no responsibility for injury to anyone else participating in the cycling tour in any role (spectator, escort, agent).
Flat Tyres organizer company disclaims any liability for accident or damage that may occur before, during and after the tour with participants/ cyclists among themselves or with third parties.
Flat Tyres organizer company bears no responsibility for any loss or destruction of material and bears no responsibility for possible damage to any equipment before, after or during the cycling tour.
Flat Tyres organizer company disclaims any financial liability or compensation in any case, to any participant/ cyclist, or other person in any capacity
Program modification-postponement-cancellation by the promoter
Flat Tyres reserves the right to modify the route, postpone the cycling trip for a short time or transfer to another date or permanently cancel in cases where safety issues arise or for reasons of force majeure such as natural disasters, inappropriate weather conditions, strikes, etc.
In case of cancellation of the cycling tour by the organizer, customers will be refunded 100% and cannot claim any other compensation.
Insurance coverage
Flat Tyres recommends that all participants / cyclists be insured before participating in any cycling trip.
Coverage and use of photographic and other material
Flat Tyres reserves the right to use photos and videos where any participant/ cyclist appears.
Acceptance of the above terms of participation
Adult participants or guardians of minors of the cycling tour accept these terms of participation and are obliged to comply with them.
RENTAL CONTRACT
For safety reasons and compliance with the terms of the rental agreement, the renter must and consents to surrender to the company his identity card or passport or driving license for the duration of the rental. The document will be returned to him upon the termination of the rental and the return of the bicycle in the condition that he received it. For the duration of the bike rental the company will hand over to the renter a copy of the document.
Minimum age is 17 years. Bike rental is forbidden to people under 17 years of age who are not accompanied by a parent or guardian.
For underage clients the guardian or the accompanying adult is responsible.
Customers-renters hereby declare that they are aware of the use of bicycles and that there is no medical instruction/indication for non-use.
The bicycle, for the rental period is in the possession of the customer-renter. The safety and security of the bicycle and equipment is his/her obligation.
The renter must lock the bike whenever left unattended.
In case of loss of the bike the customer-renter is obliged to pay the owner company the amount of 500€.
In case of mechanical damage caused during the rental, the customer-renter is obliged to pay the owner company the cost of the damaged part at its purchase price as well as the labor cost for its repair or installation.
The customer is also responsible for the safety equipment provided with the bike (helmet, lock). In case of loss or destruction, he/she must pay the amount of 20€ for the lock and the amount of 35€ for the helmet to the company.
The riders must not exceed the permitted number of persons as specified by the manufacturer and the owner company.
The renter states that before each rental he/she examines the bike and its operation and finds that it is of his/her absolute liking and that he/she receives it in excellent condition constructively and functionally. He/She does not proceed to rental if there is a defect in the rental bike. The rental of each bike implies the above statement – acceptance of all of the above.
The renter is obliged to make proper use of the rented bike and its equipment, to follow the rules of public safety, provisions for safe driving and the Traffic & Highway Code of Greece.
It is forbidden for the customer-renter to lend, rent or give the bike / equipment to a third party.
The customer-renter declares responsibly that he/she will not rent and use bicycles under the influence of alcohol or other substances.
The company has the right to refuse to lease any bicycle to persons allegedly intoxicated or under the influence of drugs and/or stimulants.
The company bears no responsibility for any accidents or personal injuries of passengers and third parties arising from improper behavior or driving of the renter and riders, as well as for damage of foreign property that will occur during the rental, and which is clearly shown by the company’s records. The user-driver-renter is solely responsible and no claim can be raised against the company for the above reasons.
Fines and any other violations imposed during the rental are entirely and exclusively borne by the tenant.
The company bears no responsibility for any damage to the personal property of the customer, e.g. bags, glasses, cameras, clothes, etc.
The customer-renter commits to return the bike at the specified delivery dates. In case of non-return there is a corresponding charge, which is set at the amount of 20€ for each day of delay.
In case of return of the bike earlier than the designated date and time no refunds are applicable.
The renter was advised during registration to use helmet and special equipment in each rental. Helmet and special equipment is provided for free by the company to the renter on each lease.
The rent is paid in advance for the entire rental days, prior to collecting the equipment, in cash or by debit/credit card.
The collection and return of bicycles is done only at the company’s offices and within its opening hours.
In any dispute arising from the lease, the Greek law is applicable and the courts of Athens are competent, while for any issue that there is no explicit provision here, the provisions on renting a thing of the Civil Code apply additionally.
